Nem hazudozhat, és nem vádaskodhat tovább a Fidesz a 4-es metróval kapcsolatban, mivel az Európai Csalás Elleni Hivatal (OLAF) hivatalos értesítése szerint a beruházás ügyében folytatott vizsgálatuk teljes jelentése a Polt Péter által vezetett Legfőbb Ügyészség birtokában van.
Mindezt az a levél tartalmazza, melyet az OLAF válaszként küldött meg részemre, azt követően, hogy az MSZP Európa Parlamenti képviselőjeként kértem tőlük a 4-es metróval kapcsolatos vizsgálat teljes dokumentációjának nyilvánosságra hozatalát.
A levélből világosan kiderül, hogy a Fidesz végig hazudott: a teljes vizsgálati anyag nyilvánosságra hozatalához nincs szükség az OLAF engedélyére. A hivatalos válasz szó szerint így fogalmaz: „Ezt a döntést elsősorban azok a nemzeti hatóságok hozhatják meg, akik a jelentést először megkapták.”
Az MSZP felszólítja Polt Péter legfőbb ügyészt, hogy a lehető leghamarabb hozza nyilvánosságra teljes terjedelmében az OLAF jelentését a 4-es metró beruházásáról.
Amennyiben a legfőbb ügyész ezt nem teszi meg, azzal nem csak azt a gyanút erősíti, hogy a Fidesz eddigi alaptalanul vádaskodott, hanem azt is, hogy az OLAF megállapításai épp a Fideszre nézve tartalmaznak terhelő tényeket.

Thank you for your email and for your interest in OLAF”s activities. I apologise for the delay in getting back to you.
As a general background, please note that all information collected in the course of OLAF investigations is subject to professional secrecy in accordance with Article 339 TFEU and with the relevant legal provisions on OLAF investigations and on the protection of personal data. In that respect, it is OLAF”s particular duty to ensure that any information made public is presented neutrally and impartially, and that its disclosure not only respects the confidentiality of investigations but also complies with the principle of presumption of innocence and with the necessary procedural guarantees.
OLAF can confirm that it has concluded an investigation into the alleged fraud and irregularities related to the development of Metro Line 4 in Budapest, Hungary. In line with the requirements set out in Regulation 883/2013, OLAF”s final report and recommendations on the case were transmitted to the Directorate General for Regional and Urban Policy (DG REGIO), the European Investment Bank (EIB), the Office of the Public Prosecutor in Hungary, the Hungarian Anti-fraud Coordination Service (AFCOS) and to the UK judicial authorities. It is now up to these authorities to assess the need for further action based on OLAF”s findings.
In response to your question, since the OLAF final report has now reached its intended recipients, the Office is not in a position to decide on the possible release of the report. Such a decision belongs in the first place to the national authorities to which the report was addressed. It is for these authorities to assess the impact of a possible release of the report and to ensure compliance with the relevant legal obligations on judicial secrecy, data protection and procedural rights, including the right of access to file.
